Buy & Sell Terms
These terms apply to the Expatify Buy & Sell classifieds. Expatify only hosts the ads: we are not the seller or the buyer, we do not pass on messages, check items, take payments or guarantee any deal, and sellers are responsible for what they post. Some items are not allowed, ads that break the rules are removed, and you should follow our safety tips before you meet or pay.
These terms apply when you post, answer or browse an ad in the Expatify Buy & Sell classifieds at /classifieds/. They add to our general Terms and Conditions and our Reviews and User Content Policy. If these terms and the general terms say different things about the classifieds, these terms apply.
By posting an ad or contacting a seller, you agree to these terms.
1. Who we are
Expatify is operated by Drakestar Ventures Ltd, a company registered in Cyprus under number HE469158. Full details are in our Legal Notice.
2. What Expatify does, and what it does not do
Buy & Sell is a free noticeboard where people in Cyprus can sell, swap or give away their own things and offer small jobs and services. Our role is limited to hosting the ads. Buyers contact sellers directly, using the contact details the seller chose to show on the ad.
Expatify:
- is not a party to any sale. Any agreement is made directly between the buyer and the seller;
- does not pass on, read or keep messages between buyers and sellers: you contact each other directly, by email or phone;
- does not own, inspect, store, deliver or value any item, and does not check that a seller owns what they offer;
- does not take or hold payments, and offers no escrow, buyer protection or refunds;
- does not check every ad before it goes online. Ads go live once the seller confirms their email address. We act on reports and remove ads that break these terms;
- does not guarantee that an item exists, is as described, is safe, legal or works, that a seller or buyer is who they say they are, or that a deal will go ahead.
3. Who can post
You must be at least 18 years old and live in Cyprus, or be selling something that is in Cyprus. Ads are for private people selling their own things and for people offering small services. Businesses with a shop or office belong in our Directory, and homes to rent or buy are not listed in Buy & Sell.
If you sell as part of a business (for example you buy items to resell), you must say so clearly in the ad. Buyers then have extra rights under consumer protection law, and you are responsible for meeting them.
4. Your responsibilities as a seller
When you post an ad, you confirm that:
- you own the item or have the right to sell it, and it is not stolen, under finance or held as security, unless you say so in the ad;
- the title, description, condition, price and photos are honest and complete, and you mention any faults you know about;
- the photos are your own, or you have permission to use them;
- the item and the sale are legal in Cyprus, and you will meet any legal requirements that apply to it (for example transferring a vehicle's registration);
- you will deal fairly and politely with people who contact you, and remove or mark the ad as sold when the item has gone.
You are solely responsible for your ad, for your dealings with buyers and for any taxes, fees or legal duties linked to your sale.
5. Your responsibilities as a buyer
Before you pay, look at the item, check that it works and that it matches the ad, and make sure the seller has the right to sell it. For vehicles, check the registration documents and the vehicle's history. You deal with the seller at your own risk.
6. Items and ads that are not allowed
You must not post ads for, or that involve:
- weapons, including firearms, air guns, replica guns, ammunition, explosives, fireworks, knives designed as weapons, pepper spray and stun devices;
- drugs and medicines, including illegal drugs, cannabis products, prescription medicines, medical devices that need a prescription, and drug paraphernalia;
- live animals, including pets, livestock, birds and fish. Pet accessories are allowed. To rehome an animal, contact a licensed shelter or rescue group, which can do so in line with Cyprus animal welfare rules;
- protected wildlife and products made from protected species, such as ivory or certain shells and corals;
- alcohol and tobacco, including e-cigarettes and refills;
- counterfeit, copied or stolen goods, and items that infringe someone else's trade mark or copyright (for example pirated software, films or games);
- adult content, sexual services, escort services and anything that sexualises minors;
- financial schemes, including investments, loans, cryptocurrency offers, "get rich quick" plans, pyramid or multi-level marketing schemes, and requests for upfront fees;
- personal documents and data, such as passports, ID cards, driving licences, bank accounts, SIM cards registered to someone else, or lists of personal data;
- recalled or unsafe products, such as recalled baby products, car seats that have been in a crash, or electrical items that are not safe to use;
- items for which a licence is needed that you do not hold, such as hazardous chemicals or pesticides restricted to professional users;
- property to rent or buy;
- jobs that break our Jobs Board Terms. Small jobs and services in the "Jobs & services" category must follow the same rules as the jobs board: for example, no fees for candidates and no discriminatory ads;
- anything illegal in Cyprus, and anything that encourages illegal activity;
- ads that ask for payment in advance, deposits by money transfer, or payment by gift card or cryptocurrency;
- spam, repeated ads for the same item, misleading categories, links to other selling sites, or ads that collect personal data.
Ads must not be discriminatory, hateful, threatening, defamatory or offensive. This list is not complete: we may remove other ads that we reasonably consider unsafe, unlawful or not suitable for the site.
7. Safety tips
Most people who use the classifieds are genuine, but scams happen on every noticeboard. Please:
- meet in a busy public place, in daylight, or bring a friend. Do not invite strangers into your home if you can avoid it;
- look at the item and check it works before you pay;
- never pay in advance to someone you have not met, and never pay by gift card, cryptocurrency or money transfer services to a stranger;
- never share codes sent to your phone, passwords or bank login details;
- be wary of buyers who offer to pay more than the asking price, ask you to send money back, use a courier you have never heard of, or send a "payment link";
- be wary of prices that look too good to be true and of sellers who are "abroad" and want to ship the item;
- keep your messages in writing (by email or text), so you have a record.
If you think you have been the victim of a crime, contact the Cyprus Police on 112 and report the ad to us.
8. How buyers contact sellers
Each ad has a "Contact the seller" button. When a buyer clicks it, the seller's email address is shown, and the buyer writes to the seller directly from their own email. If the seller ticked "Show my phone number on the ad" when posting, the phone number is shown too; otherwise we do not ask for or keep a phone number. Only the seller's first name is shown on the ad itself.
By posting an ad, you agree that your email address (and your phone number, if you chose to show it) is shown to people who click "Contact the seller". Expatify does not send, receive, read or store messages between buyers and sellers, so we cannot see, recover or check them: keep your own record. Anyone who receives your contact details through an ad may only use them to deal with you about that ad. How we handle personal data is explained in our Privacy Policy.
9. How long ads stay online
An ad stays online for 60 days and can be renewed for free. Ads that are not confirmed by email within a few days, and ads that have expired for some time, are deleted with their photos.
10. Removing ads and suspending users
We may, at any time and without notice, edit the category of an ad, hide it, remove it, or stop a person from posting, if:
- the ad breaks these terms or the law;
- we receive a report that we consider well founded;
- we reasonably believe the ad is a scam, spam or a risk to other users;
- a person repeatedly posts ads that break the rules.
When several different people report an ad, it may be hidden automatically until we have looked at it. When we remove an ad or restrict an account, we tell the seller why by email, unless the law or a risk of harm stops us. You can ask us to look at the decision again; see our Report Illegal Content page for how this works.
11. Reporting an ad
Every ad has a "Report this ad" link. To report illegal content in more detail, follow the steps on our Report Illegal Content page.
12. Our liability
Expatify provides the classifieds as a hosting service and is not responsible for the ads people post, for items, or for anything that happens between buyers and sellers, including payments, delivery, the quality, safety or legality of items, or the behaviour of other users.
To the extent the law allows, we are not liable for any loss or damage arising from an ad, a message, a sale or a meeting between people who found each other through the classifieds. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, for fraud, or your statutory rights as a consumer. Our general limitation of liability is in our Terms and Conditions.
13. Indemnity
If you post an ad that breaks these terms or the law, you agree to cover the reasonable costs, losses and legal claims that Expatify suffers because of it, including reasonable legal fees. This does not apply to the extent that a loss was caused by our own fault.
14. Changes to these terms
We may update these terms, for example when we add new features or when the law changes. The date at the top of the page shows the latest version. Changes do not apply to ads already posted until they are renewed, unless the law requires otherwise.
15. Law and courts
These terms are governed by the laws of the Republic of Cyprus, and the courts of Cyprus have jurisdiction. If you are a consumer living in another EU country, you also keep the protection of the mandatory rules of that country and may bring a claim in its courts.
16. Contact
